An Ohio sheriff’s deputy has been charged with assault after being filmed kicking a prisoner in the head after the prisoner bit his boot.

“As a sheriff, I am indignant and shocked at this blatant behavior. These actions are not consistent with our training and will not be tolerated under my supervision, “Neil said in a statement.

While arrested by Cincinnati police, Ballachino had been taken to the Hamilton County Justice Center for processing.

Prosecutors found that the charges did not apply because he had not been “seriously injured”.

Franklin’s case will be transferred to the city of Cincinnati as they deal with crimes within the city boundary. If convicted, Franklin will be behind bars at the Justice Center for six months.
